Terms of Use

These terms govern your access to and use of the Pacia Engineering Intelligence platform, including app.pacia.io, our API, our Microsoft Teams application and our IDE extensions (together, the "Service"). By using the Service you agree to these terms. If you are agreeing on behalf of an organisation, you confirm you have authority to bind that organisation.

The Service

Pacia connects to your engineering tools to produce delivery metrics, insights and forecasts. Insights and forecasts are indicative only: they are derived from the data available to us and are intended to support human judgement, not replace it. You remain responsible for decisions you make using them.

Accounts

  • You must provide accurate account information and keep it current.

  • You are responsible for activity under your account and for keeping credentials — including any access tokens you supply — secure.

  • You must notify us promptly of any unauthorised use of your account.

Acceptable use

You agree not to:

  • Use the Service unlawfully, or to infringe anyone’s rights.

  • Attempt to gain unauthorised access to the Service, other customers’ data, or any underlying infrastructure.

  • Interfere with or disrupt the Service, including by circumventing rate limits or probing for vulnerabilities without our written permission.

  • Resell or redistribute the Service without our written agreement.

Your data

You retain ownership of the data you connect to Pacia. You grant us the limited right to process it in order to provide the Service. Our handling of personal data is described in our Privacy Policy. You are responsible for having the necessary rights and permissions to connect the tools and data you choose to connect.

Third-party integrations

The Service integrates with third-party products (for example GitHub, Microsoft Teams and AI coding assistants). Those products are governed by their own terms, and their availability is outside our control. We are not responsible for changes to, or the discontinuation of, third-party APIs.

Availability and changes

We aim to keep the Service available and reliable, but it is provided without any guarantee of uninterrupted availability. We may modify or discontinue features, and will give reasonable notice of material changes that adversely affect paid customers.

Fees

Where the Service is provided on a paid basis, fees and billing terms are as agreed in your order or subscription. Unless stated otherwise, fees are exclusive of tax and are non-refundable except where required by law.

Termination

You may stop using the Service and close your account at any time. We may suspend or terminate access if you materially breach these terms, or where required by law. On termination, your right to use the Service ends and we will delete or anonymise your data as described in our Privacy Policy.

Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special or consequential losses, or for loss of profits, revenue, data or goodwill. Our total aggregate liability arising out of or relating to the Service is limited to the amounts paid by you for the Service in the twelve months preceding the event giving rise to the claim. Nothing in these terms limits liability that cannot lawfully be limited.

Changes to these terms

We may update these terms from time to time. Material changes will be communicated to account administrators, and the "last updated" date above will change. Continued use of the Service after changes take effect constitutes acceptance.
